If you and your spouse have been married for 2 or more years, it is likely that you will be considered “spouses” for the purposes of property and debt division.

Family property is property owned (either legally or beneficially) by either or both spouses on the date of separation.

Family debt is debt incurred during the relationship. Debt incurred after separation only presumed to be family debt if it is incurred to maintain family property.

Excluded property generally includes property you acquired before your relationship, gifts from a 3rd party, personal injury settlement.
